However , Judge James Donato ruledthat because “ Facebook scans exploiter - uploaded photographs to make a ‘ singular digital histrionics of the face . . . base on geometric kinship of their facial features , ’ ” it falls under BIPA .

Facebook also submit a move to get the font thrown out based on the fact that any user agreements fall under California constabulary . The jurist deny this request .
